1. Introduction

These Terms of Service (“Terms”) govern the use of my website and the provision of historical research, writing, and consulting services. By engaging my services or accessing my website, you agree to be bound by these Terms. Please read them carefully before proceeding.

2. Services

I provide professional historical research, writing, and consulting services. The scope, deliverables, and fees for each project will be agreed in writing prior to commencement. All services are conducted with due care, skill, and professionalism, in accordance with accepted research and ethical standards.

3. Client Responsibilities

Clients are responsible for:

• Providing accurate and complete information relevant to the project;
• Ensuring they have the right to share any materials or data supplied; and
• Using research outputs responsibly and in accordance with applicable laws.

4. Fees and Payment

Fees, payment schedules, and any applicable expenses will be confirmed in writing before work begins. Payment is due within the time stated on the invoice. Late payments may incur reasonable administrative fees.

5. Use of Research Outputs

Unless otherwise agreed in writing, research outputs, reports, and materials are provided for personal, educational, or organisational use only. They may not be reproduced, distributed, or published without prior written permission. Proper attribution or citation is required where appropriate.

6. Intellectual Property

All intellectual property rights in research materials, analyses, and written work remain with the author unless otherwise agreed in writing. Clients receive a licence to use commissioned work for the agreed purpose only.

7. Accuracy and Limitations

While every effort is made to ensure accuracy, historical and genealogical research inherently involves interpretation of available evidence. I make no guarantee that findings are exhaustive or free from error, and I accept no liability for decisions made based on the information provided.

8. Confidentiality and Privacy

All client information is treated as confidential and handled in accordance with my Privacy Policy and applicable privacy laws, including the Privacy Act 1988 (Cth).

9. Cancellations and Termination

Either party may terminate a project with reasonable notice. Fees will be payable for all work completed up to the date of termination. Deposits may be non-refundable if work has commenced or resources have been committed.

10. Liability

To the extent permitted by law, I am not liable for any loss, damage, or consequential claims arising from the use of my research, reports, or advice. My total liability in connection with any service is limited to the amount paid for that service.

11. Governing Law

These Terms are governed by the laws of Australia and the state or territory in which I operate. Any disputes will be subject to the jurisdiction of the relevant Australian courts.
